Court halts Saraki’s trial for ‘false asset claims’

Court halts Saraki’s trial for ‘false asset claims’
September 17
22:19 2015

The Abuja federal high court has momentarily halted the trial of Senate President Bukola Saraki by the Code of Conduct Bureau (CCB) for alleged false declaration of assets.

Mahmud Magaji (SAN), Saraki’s counsel, had filed an ex parte application before Justice Ahmed Mohammed of ‎the court, asking him to halt his prosecution by the CCB.

Consequently, the court ruled  that the respondents  (CBB, Code of Conduct Tribunal and the ministry of justice)  appear before it next Monday week to show cause why the case should not be dismissed.

A copy of the ruling seen by TheCable read: “An order is hereby made directing the respondents to appear before this court on Monday, September 21, 2015 and show cause why the interim orders of injunction being sought by the plaintiff/applicant should not be made by the court.

“All the respondents should be served with the originating summons filed in this suit, it’s accompanying affidavit, the motion on notice for interlocutory orders of injunction, the motion exparte for interim orders of injunction, the affidavit of urgency all the exhibits attached to the various affidavits filed.

“Hearing notices shall also be issued on all the respondent‎. The return date for the respondents to appear and show cause shall be the 21st of September. These orders are made pursuant to the provisions of order 26 rules 10 and 13 of the federal high court (Civil procedure) rules, 2009.”

Saraki was to be arraigned before the Code of Conduct Tribunal on Friday.

There we go again!!! Our judges have started to dish out injunctions to stop corrupt public servants from being prosecuted. I read that another judge has also barred the Police, EFCC, ICPC etc from even investigating one Kuku (ex NDDC boss). Is the judiciary not the real reason corruption has become the order of the day? An house girl steals her madam’s underwear and is sent to prison without the option of a fine !! A governor steals N5 billion, the case drags on for 10 years and he is flying about in a private jet. Where is the fairness in the system?

The reality of life is that “money talks”. It’s everywhere. It’s not easy to prosecute the rich because they can afford the best defense that money can buy. This is not unusual. It’s the way the world works. However, look at it this way: a sitting Senate President is being held accountable for false declaration of assets. Change is finally coming to Nigeria. It’s a positive thing for the country. It will be slow because we didn’t get to this pathetic state overnight.
