A Belgian man has been acquitted of drunk driving after doctors confirmed he suffers from auto-brewery syndrome (ABS).

Auto-brewery syndrome is a very rare condition where the body produces large intoxicating amounts of alcohol.

ABS, also known as gut fermentation syndrome, has been described by doctors as a “clinical dilemma” and typically presents with the signs of alcohol intoxication, such as staggering gait, slurred speech, gastrointestinal distress, and a state of confusion.

While individuals are not born with the disease, it is more prevalent in patients with underlying gut problems.

Anse Ghesquiere, the man’s lawyer, told Reuters that in “another unfortunate coincidence”, her client works at a brewery.

However, three doctors who independently examined him confirmed he suffered from ABS.

The 40-year-old was first convicted of drink driving in 2019. At the time, he was not aware of his condition.

It was after both incidents that he had himself examined by doctors, who diagnosed him, with ABS.

According to reports, the judge said the defendant, who was not named in line with local judicial custom, did not experience symptoms of intoxication.

The judge also did not order a driving ban, but instead ruled that the man must take measures – such as dietary changes or an alcolock that prevents him from driving over the limit – or face a conviction if he fails a future breath test.
