Faleke sues INEC, says he is governor-elect

James Faleke, running mate to the late Abubakar Audu, candidate of the All Progressives Congress (APC) in the November 21 election in Kogi state, has filed a suit at the federal high court in Abuja, seeking that he be declared as governor-elect.

Shortly after the APC announced the choice of Yahya Bello as the replacement for Audu, Faleke vowed to challenge the decision in court.

The court papers were served on the Independent National Electoral Commission (INEC) on Tuesday afternoon.

Faleke had earlier expressed dissatisfaction with the decision of INEC to declare the election inconclusive and mandate the APC to replace Audu.

He argued that having ran on a joint ticket with Audu, he ought to have been declared winner of the election.

At the national secretariat of the APC in Abuja on Monday, Faleke said he was not interested in the supplementary poll scheduled for Saturday.

“I will not be part of the election, and because I have pulled out it will be null and void,” he had said.

“We are going to challenge the decision of the party in court. I am not a deputy governor to anybody. They took the decision and just invited us. I also told him, Mr chairman for us as a family, Kogi state political family we are not taking part in that election, my name cannot be submitted because I was not even consulted in the first instance.”
