Abdullah Abubakar, counsel representing Abubakar Malami, attorney-general of the federation (AGF), says there is no evidence linking the AGF to the raid on the Ibadan residence of Sunday Adeyemo, better known as Igboho.

Igboho had sued the AGF, the Department of State Services (DSS), and director of state services, Oyo state, demanding N5.5 billion in damages over the raid on his Ibadan home on July 1.

Two persons were said to have been killed, while 12 others were arrested following the raid.

At the court session on Tuesday, Yomi Alliyu, Igboho’s lawyer, tendered a video clip showing the impact of the raid on his client’s residence.

I.A. Nurudeen, DSS counsel, also tendered a video where Igboho allegedly threatened to create “Oduduwa Republic”, break away from Nigeria and asked Yoruba indigenes to fortify themselves with charms and guns.

Addressing the court after playing the two video clips in open court, the AGF’s counsel said there was no evidence before the court that the blood seen in the video tendered by Igboho’s counsel belongs to humans.

Abubakar also said there was nothing in the video clip that showed that the house that was invaded belonged to Igboho, or linked the AGF to the raid.

He urged the court to disregard the exhibit and dismiss the entire suit.

On his part, the DSS counsel aligned with the AGF’s submission, adding that there must be proof from a haematologist on if the blood seen in the video belongs to a human or an animal.

Responding, Alliyu said that the video clip tendered by the DSS can be referred to as “a cinema recording”, because the language used in the video was Yoruba, which is not the language of the court.

He said the DSS did not tender any evidence denying the “killings or invasion” of his client’s house and “damaging some properties therein”.

Ladiran Akintola, the presiding judge, admitted the video clips as exhibits.

Akintola thereafter adjourned the case till September 17 for ruling and judgment.
