S’court strikes out Nwoko’s petition, upholds Nwaoboshi as senator

The supreme court has dismissed two suits filed by Ned Nwoko challenging the election of Peter Nwaoboshi, senator representing Delta north.

Nwaoboshi had emerged candidate of the Peoples Democratic Party (PDP) in the October 2, 2018, primary of the party held in Delta state.

Nwoko had filed a suit to challenge the emergence of Nwaoboshi.

The 59-year-old politician was pronounced senator after an Abuja high court sacked Peter Nwaoboshi on the grounds that he was not the duly elected candidate of the PDP in the primary election.

Dissatisfied with the judgement, Nwaobishi appealed the judgment before a court of higher jurisdiction.

The court ruled that the initial case filed by Nwoko before the high court is statute barred as it exceeded 14 days from the time of the incidence that birthed the suit.

The appeal court returned Nwaobishi as senator for Delta-north.

Nwoko proceeded to the supreme court to challenge the decision of the appeal court.

In the ruling on Tuesday, Inyang Okoro-led five-man panel dismissed the suits for lack of jurisdiction.
