Senatorial poll: Ekpeyong floors Akpabio at tribunal

The election tribunal has upheld the victory of Christopher Ekpenyong as the winner of Akwa Ibom north-west senatorial district at the national assembly.

Akpabio had challenged the Independent National Electoral Commission’s (INEC) declaration of Ekpeyong as winner of the February 23 election.

The court dismissed all the preliminary objections filed by Akpabio, holding that the petitioner’s evidence was too weak in all ramifications to prove non-compliance, not to mention substantial non-compliance, which is the only ground for nullification of the elections.

The court further said the petition failed to bring any witness from the polling units and thus could not prove substantial non-compliance with the electoral act.

The court in the end, upheld the declaration of Ekpenyong as winner of the February 23, 2019 election.

There was, however, a dissenting judgement by one of the 3 judges of the tribunal.
