APC to challenge court orders against Buhari

The All Progressives Congress (APC) and its presidential candidate, Muhammadu Buhari, are planning to challenge the court order requesting a service of his academic credentials.

At an Abuja high court on Monday, the APC and Buhari, represented by Wole Olanipekun (SAN) and Lateef Fagbemi, said they were going to challenge the suits questioning the qualification of Buhari based on academic records.

Earlier, suits filed by Max Ozoaka and Chukwunweike Okafor have requested the disqualification of Buhari, saying he lied under oath with respect to the possession of his certificate.

Consequently, Justice Adeniyi Ademola, the presiding judge, made an order of substituted service on Buhari and the Independent National Electoral Commission, who are the two defendants in the suit.

In response to this, the counsel for Buhari and APC informed the court that it was going to challenge the competence of the suits filed, requesting time to file necessary documents.

Ademola answered the prayers of the defendants by adjourning the case to February 23.

In Ozoaka’s suit, FHC/ABJ/CS/14/2015, he argued that the INEC FORM CF 001 submitted to INEC by the APC candidate was incomplete, urging the court to declare the form as “not in conformity with the form prescribed under the Electoral Act”.

In a supporting affidavit to the originating summons, Ozoaka said the INEC Form submitted by Buhari did not meet the requirements under Sections 31(1)(2) & (3), and 31(8) of the Electoral Act 2010 (as amended).
